Welcome to Pod Penguin, a service operated by MT Software Labs (“Pod Penguin,” “we,” “us,” or “our”). By accessing or using our service, you agree to be bound by these Terms of Use. Please read them carefully before using our platform.

1. Acceptance of Terms

By creating an account or using Pod Penguin, you agree to these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our service.

2. Description of Service

Pod Penguin is a weekly email digest service for podcasts. You select the podcasts you follow, and we deliver a curated summary of new episodes to your inbox. Depending on your plan, the service may include:

  • A weekly “what's new” digest of episodes from the shows you follow
  • AI-generated short summaries highlighting the key takeaways of each episode
  • Long-form summaries with quotes, contrarian takes, and the option to expand specific points
  • A searchable archive of past digests and summaries
  • Tools to manage the podcasts you follow, including pausing and removing shows

Features and limits available to you depend on the plan you are subscribed to. We may add, modify, or remove features over time.

3. User Accounts

To use Pod Penguin, you must sign in using Google. Your registered email address is where we deliver the weekly digest. You are responsible for:

  • Maintaining the security of the Google account you use to sign in
  • All activity that occurs under your Pod Penguin account
  • Notifying us promptly of any unauthorized access
  • Ensuring the contact information on your account is accurate

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Pod Penguin.

4. Acceptable Use

You agree not to use Pod Penguin to:

  • Violate any laws or regulations
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots, scrapers, crawlers) to access the service, except as expressly permitted
  • Share, sell, or transfer your account credentials
  • Resell, redistribute, or republish the digests or summaries we generate for you, in whole or in part, without our written permission
  • Interfere with or disrupt the integrity or performance of the service

5. Intellectual Property

Our Content: The Pod Penguin website, brand, software, and the layout and presentation of the digests are owned by Pod Penguin and protected by copyright, trademark, and other intellectual property laws.

Podcast Content: Pod Penguin does not own the underlying podcasts. All rights in podcast episodes — including audio, transcripts, titles, and artwork — belong to the original creators, publishers, and rights holders. We use publicly available metadata and transcripts to produce short, transformative summaries intended for your personal use.

Your Use of Summaries: Summaries generated by Pod Penguin are provided for your personal, non-commercial use. You understand that:

  • Summaries are AI-generated derivative works based on third-party podcast content
  • Summaries may contain inaccuracies, omissions, or misinterpretations
  • You should respect the rights of podcast creators when quoting or sharing summaries
  • You may not use Pod Penguin output to train competing AI models or build a competing service

6. AI-Generated Content Disclaimer

Summaries, takeaways, and other digest content are produced by automated AI systems. While we work to make them accurate and useful, they are not a substitute for listening to the original episode and may misrepresent the speakers' views, omit important context, or contain factual errors. Do not rely on Pod Penguin summaries for medical, legal, financial, or other professional advice.

7. Subscription Plans and Payment

Free Plan:Our free plan lets you track a limited number of shows and receive the weekly “what's new” digest at no cost.

Paid Plans: Paid plans (such as Signal and Deep Dive) unlock summaries and higher show limits. By subscribing to a paid plan, you agree to:

  • Pay the subscription fee on a recurring basis at the cadence shown at checkout (typically monthly)
  • Automatic renewal at the end of each billing period unless you cancel beforehand
  • Pricing changes with at least 30 days' notice before they take effect on your subscription

Payments are processed by our third-party payment provider. We do not store full payment card details on our servers.

Waitlist and pre-launch tiers: Some plans may be available only via a waitlist before launch. Joining a waitlist does not create a subscription or an obligation to pay; we will contact you separately when a plan is available for purchase.

8. Cancellation and Refunds

Paid plans are billed monthly. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of your current billing period, after which you will not be charged again. Fees already paid for the current billing period are non-refundable.

Upon cancellation:

  • You retain access to paid features until the end of your current billing period
  • Your account will revert to the free plan when the billing period ends
  • Digests and summaries previously delivered to your inbox remain yours; in-app archive access may be limited based on your plan

We may suspend or terminate your account if you materially breach these Terms, including for fraud, abuse, or violations of the Acceptable Use section above.

9. Email Communications

Pod Penguin is fundamentally an email service: by signing up, you consent to receive the weekly digest and related transactional emails (account, billing, and service updates) at the email address linked to your account. You can stop receiving the weekly digest by cancelling your subscription or deleting your account. Some transactional emails may continue while your account is active.

10. Third-Party Services

Pod Penguin relies on third-party services to operate, including Google (for authentication), our cloud infrastructure provider, our email delivery provider, our payment processor, and the AI models that generate summaries. Use of those services is also subject to their own terms. We are not responsible for the availability or behavior of third-party services beyond our reasonable control.

11. Disclaimers and Limitation of Liability

Service "As Is":Pod Penguin is provided “as is” and “as available,” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted or error-free service, nor that summaries will be accurate or complete.

Limitation of Liability: To the maximum extent permitted by law, Pod Penguin and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the service. Our total aggregate liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or USD $50, whichever is greater.

12. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where the owner of Pod Penguin resides at the time a dispute arises, without regard to its conflict of laws principles. Any dispute arising out of these Terms or your use of Pod Penguin shall be resolved exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms of Use from time to time. When we make material changes, we will notify you by email or via a notice in the service before the changes take effect. Your continued use of Pod Penguin after the effective date constitutes acceptance of the updated terms.
